Identification clause
The identification clause identifies the car insurance policy and it's creator, for example:
This policy and the schedule shall be read together and any word or expression to which a specific meaning has been attached in any part of this policy or of the schedule shall bear such meaning wherever it may appear.
In all scheduled policies the above clause appears, usually before the conditions.
One of the most firmly established and fundamental maxims in insurance practice generally is that any ambiguity in the wording of a policy or other insurance document shall be construed against the person(s) responsible for drafting the document – i.e. the Car Insurers and the identification clause cited above is an example of the measures which insurers will take to ensure that there is uniformity of meaning and no ambiguity in the wording of their documents. Such ambiguities will be exploited if a claim goes to court.
